Terms of Use

Important

Please read these Terms of Use carefully before using the services offered by Tripanya. These terms set forth the legally binding terms and conditions for your use (as "User(s)") of the website at tripanya.com and the Tripanya Android and iOS apps (the "Platform"), together with the services, features, content and tools offered by Tripanya (collectively with the Platform, the "Service").

Tripanya is a travel planning and sharing platform that lets you build your route day by day, add photos, notes and expenses to your stops, and share your experiences with a community of travellers.

Acceptance of Terms

By registering for and/or using the Service in any manner, including but not limited to visiting or browsing the Platform, you agree to all of the terms and conditions contained herein ("Terms of Use"), which also incorporate Tripanya's Privacy Policy. Any amendment of these Terms of Use will be announced at least one (1) month before it takes effect. If you do not agree to an amendment, you have the right to terminate the agreement as of the date the amendment would have entered into force.

Access

Subject to these Terms of Use, Tripanya may offer to provide the Services, as described in more detail on the Platform and selected by you as User, solely for your personal (non-commercial) use.

Registration and Eligibility

You may browse the Platform and view content without registering, but as a condition to using certain aspects of the Service, you are required to register and provide Tripanya with accurate and complete registration information (including a user name, email address and password). You must keep this information up to date. The Service is not available to individuals who are younger than 16 years old.

You shall not:

  • create any account for anyone other than yourself without their permission;
  • use a user name that is the name of another person with the intent to impersonate them;
  • use a user name or account subject to the rights of another person without authorization;
  • use a user name that is offensive, vulgar, misleading or otherwise unlawful.

You are solely responsible for activity that occurs on your account and for maintaining the confidentiality of your password. You will immediately notify Tripanya in writing of any unauthorized use of your account.

Your Content

For purposes of these Terms of Use, "Content" includes, without limitation, any location information, videos, audio clips, comments, data, text, photographs, photo albums and interactive features generated or made accessible through the Service. You retain the intellectual property rights relating to the Content you make available through the Service.

By making Content available through the Service, and within the limits of the privacy settings you have chosen, you grant Tripanya a worldwide, royalty-free, transferable license to reproduce, distribute, adapt and display that Content for the purpose of providing the Service. This means that if you set certain Content to be public, Tripanya may display it in connection with the Platform and its services.

When you delete your Content, it is removed from the Service. However, you understand that removed Content may persist in backup copies for a reasonable period (but following removal will not be shared with others).

Rules and Conduct

As a condition of use, you promise not to use the Service for any purpose prohibited by these Terms of Use. By way of example, and not as a limitation, you shall not upload or distribute any Content that:

  • infringes any intellectual property, privacy or other right of a third party;
  • you know is false, misleading or untruthful;
  • is unlawful, threatening, abusive, defamatory, obscene or promotes hatred;
  • constitutes unauthorized advertising, junk mail or "spam";
  • contains software viruses or any other harmful computer code.

You also agree not to interfere with the proper working of the Service, not to harvest content through automated means (crawling or scraping), and not to reverse engineer any part of the Service. Tripanya reserves the right to remove, suspend or modify any Content at its sole discretion and without notice.

Third Party Sites and Services

The Service may permit you to link to other websites, apps or resources on the Internet. When you access third party websites, you do so at your own risk. These sites are not under Tripanya's control, and Tripanya is not responsible for their content, functions or accuracy. This includes downloading the Platform from third party application stores such as the Apple App Store and Google Play Store.

Termination

Tripanya may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice. If you wish to terminate your account, you may do so by following the instructions on the Platform. All provisions of these Terms of Use which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Warranty Disclaimer

The Platform and Services are provided on an "as is" basis. Tripanya does not warrant that the Platform and Services are accessible or fully functional at all times. Tripanya has no control over which users gain access to the Service, what Content you access, or what effects that Content may have on you.

Liability and Indemnification

You agree to defend, indemnify and hold harmless Tripanya, its affiliates and their employees from all losses, costs, claims and expenses that arise from or relate to your use or misuse of the Platform, Service or Content, or your violation of these Terms of Use.

Governing Law

These Terms of Use and any disputes arising out of or in connection with them shall be governed by, and construed in accordance with, the laws of the Republic of Türkiye. All disputes arising out of these Terms of Use shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Istanbul.
